2009 FIELD & STREAM TOTAL OUTDOORSMAN CHALLENGE

ELIGIBILITY REQUIREMENTS & REGULATIONS

ALL FEDERAL, STATE, LOCAL AND MUNICIPAL LAWS AND REGULATIONS APPLY.  VOID WHERE PROHIBITED.

The 2009 Field & Stream Total Outdoorsman Challenge (the “Challenge”) is produced and organized by Blue 3 Productions, Inc. and Field and Stream Magazine (the “Organizers”).

ELIGIBILITY: Subject to the additional restrictions below, the Challenge is open to United States residents (excluding Puerto Rico) regardless of state of residency. Applicants must be 21 on or before the date they are selected to compete. All applicants must be in excellent physical and mental health and must not have been convicted of any felony or violation of any fish or game-related law or regulation. Applicants must be available to attend and participate for the duration of all scheduled events required for the competition (3-4 days for the Championship, 1 day for the Qualifiers and/or Regionals) and each applicant must be willing to travel to the appropriate Challenge location. Applicants must have experience in both hunting and fishing (including proficiency with rifles, shotguns and bows). All related travel and lodging requirements will be at applicant’s sole expense. Employees of Blue 3 Productions, Inc., Bonnier Corporation or other Challenge sponsors and each of their respective affiliated companies, advertising and promotional agencies, and the immediate family members of, and any persons domiciled with any of the foregoing, are not eligible to enter or participate. The term “immediate family members” includes spouses, parents, grandparents, siblings, children and grandchildren.

HOW TO ENTER: To be considered for eligibility to compete in the Qualifier, Regional and Championship competitions fully completed and signed applications must be submitted at the Qualifier competitions at the participating Bass Pro Shops locations below:

There is no fee to apply. Organizer is not responsible for incomplete or illegible applications or for applications not received for any reason, including, without limitation, failure or malfunction of any communications network or equipment or computer software or hardware. All applications become property of Organizer and will not be returned. Due to the large number of applications anticipated, Organizer cannot answer any questions about the receipt or status of any application. Return receipt or delivery confirmation is the sole responsibility of the applicant. Organizer reserves the right to contact applicants to ask additional questions and/or conduct phone interviews with references or other third-parties to gather additional information relating to an applicant’s background and experience as it pertains to the Challenge.

QUALIFICATION GUIDELINES

BASS PRO SHOPS QUALIFIERS AND REGIONALS: A maximum of one hundred (100) outdoorsmen will be selected to participate in each Qualifier Day at the participating Bass Pro Shops locations (please refer to above chart for the specific dates and locations). The top two hundred (200) competitors nationwide from participating stores will receive an invitation to a Regional Event, to be held at the following Bass Pro locations and dates:

CHAMPIONSHIP: a maximum of sixteen (16) outdoorsmen will be selected to participate in the Championship, which is scheduled to take place on September 10 – 13, 2009 at Dogwood Canyon Nature Park in Lampe, Missouri. An automatic invitation will be extended to the 2008 Challenge 1st, 2nd and 3rd place finishers.  Twelve (12) 1st, 2nd and 3rd place winners from Bass Pro Shops Regionals, and one (1) Wild Card selection will be selected to participate in the Championship.

The individuals selected as participants or alternates for the Championship will be listed on http://www.totaloutdoorsmanchallenge.com and each individual will be notified by telephone or email.

The applicants chosen for the Championship are solely responsible for all costs and expenses of transportation and lodging associated with their participation in the Championship.  If any applicant or participant withdraws or becomes unavailable for any reason for any Championship-related event, he or she will be disqualified, forfeit the right to any prize, and be replaced by an alternate participant at the sole discretion of the Organizer.

Winners may waive their right to receive prizes. Prizes are not assignable and nontransferable. Winners are solely responsible for payment of any taxes on their prizes.  All potential winners will be required to execute an Affidavit of Eligibility and Release as a condition of receiving the award of any prize. All potential winners must finish the event in order to receive the cash prize.

RESERVATION OF RIGHTS: Organizer reserves the right to disqualify any participant for any reason, including, without limitation, unsafe, unsportsmanlike or disruptive conduct and/or any intent to intimidate, threaten, harass or harm another person.  Removal or disqualification will result in forfeiture of all right and interest in any potential prize. All decisions with respect to the removal, disqualification, replacement and/or addition of participants or teams shall be made by Organizer and Challenge judges in their sole discretion and shall be final, binding, and non-appealable in all respects. Failure to comply with any term or condition of these Official Rules, or the Challenge Rules, may result in applicants or participant’s disqualification, and the forfeiture of his or her interest in any prize. Organizer reserves the right to amend these Official Rules and Eligibility requirements, or the Challenge Rules at any time in its sole discretion, and applicants and participants shall have no recourse for any such changes or for any failure (whether inadvertent or otherwise) by Organizer, Challenge judges or other participants to follow the stated rules. Organizer also reserves the right to modify and make additions or deletions from the schedule of Challenge events and to change the date, time, location or format of any Challenge-related event. Organizer reserves the right not to conduct the Challenge. Participants may be required to execute further releases, documents and instruments, as Organizer deems necessary in its discretion. In the event that the Challenge is cancelled, no prizes will be awarded. If the Challenge is cancelled for any reason, participants will not be reimbursed or otherwise compensated for any costs or expenses associated with their participation in the competition.  The display of any nationally or internationally recognizable logos, trademarks, or trade names on any participant’s apparel or equipment is subject to Organizers’ prior approval and at Organizers’ sole discretion. Organizer will not be responsible for typographical, printing or other inadvertent errors in these Official Rules or in other materials relating to the Challenge.

PARTICIPATION: By participating in the Challenge, applicants agree to be bound by these Official Rules, the Challenge Rules, and all decisions of Organizer and the judges. Organizer and judges reserve the right to disqualify any persons found tampering with or otherwise abusing any aspect of the Challenge, as determined in the sole discretion of Organizers or the Challenge judges.

CONSTRUCTION: The invalidity or unenforceability of any provision of these Official Rules shall not affect the validity or enforceability of any other provision. In the event that any such provision is determined to be invalid or otherwise unenforceable, these rules shall be construed in accordance with their terms as if the invalid or unenforceable provision was not contained therein.

DISPUTE RESOLUTION: Except where prohibited, participation in the Challenge constitutes an agreement that: (1) any and all disputes, claims, and causes of action arising out of or connected with the Challenge, participation therein, or any prizes awarded, shall be resolved individually without resort to any form of class action and exclusively by arbitration under the Commercial Arbitration Rules of the American Arbitration Association in New York, NY, USA; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including only costs associated with entering the Challenge but in no event attorneys’ fees; and (3) under no circumstances will participant be permitted to obtain awards for, and entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages and any and all rights to have damages multiplied or otherwise increased.
